§ 7.12.030. Definitions.

  • For the purposes of this chapter, words used in the present tense include the future; the singular number includes the plural and the plural number includes the singular; and the word "shall" is always mandatory.

    For the purposes of this chapter and unless the context otherwise indicates, certain words and phrases are defined as follows:

    (1)

    "Administrator" means that person appointed to administer the department and to administer and assist in the enforcement of the provisions of this chapter.

    (2)

    "Animal carcass" means all or any part of the body of a dead animal, but excludes bodies or parts thereof originating from slaughterhouses.

    (3)

    "Ashes" means the residue of the combustion of solid fuels.

    (4)

    "Building waste" means any waste or residue resulting:

    (A)

    From building construction, reconstruction, repair or demolition;

    (B)

    From grading, landscaping, shrubbing, or other work in connection with any premises; or

    (C)

    From replacement of building equipment or appliances.

    (5)

    "Bulk waste" means articles more than six feet in length or more than fifty pounds in weight, tree trimmings and hedge trimmings over five inches in diameter or over four feet in length, or tree roots and stumps too large to be contained in a bushel basket.

    (6)

    "Commercial establishment" means a business or combination of businesses located in the same building or structure, including a business furnishing personal services and located in the owner's residence.

    (7)

    "Commercial waste" means garbage, rubbish, mixed refuse and cool ashes originating in and around commercial establishments and private institutions.

    (8)

    "Container" means a device for the storage of garbage, rubbish, mixed refuse or cool ashes which:

    (A)

    Has a tight-fitting cover or is closed;

    (B)

    Is water-tight;

    (C)

    Is of nonrusting material; and

    (D)

    When filled does not weigh more than fifty pounds.

    (9)

    "Department" means the department of sanitation of the town.

    (10)

    "Disposal site" means any location, place or tract of land used for the collection, storage, conversion, utilization, incineration or other disposition of solid waste.

    (11)

    "Garbage" means all putrescible animal or vegetable waste resulting from the handling, preparation, cooking or consumption of food in any residential premises, restaurant, hotel, motel, building or institution.

    (12)

    "Hazardous waste" means explosive materials, materials contaminated by infectious or contagious disease, fly ash or other fine or powdery material, and other material which presents a special hazard to department and disposal site personnel and equipment or to the public.

    (13)

    "Household waste" means garbage, rubbish, mixed refuse and cool ashes originating in and around residential premises or in and around dining facilities located in schools, colleges or universities.

    (14)

    "Industrial establishment" means an industry or combination of industries located in the same building or structure and engaged in industrial or manufacturing operations.

    (15)

    "Industrial waste" means garbage, rubbish, mixed refuse and residues resulting from industrial or manufacturing operations.

    (16)

    "Institutional waste" means garbage, rubbish, mixed refuse and cool ashes originating in and around tax exempt hospitals and public, charitable, philanthropic or religious institutions conducted for the benefit of the public or a recognized section of the public.

    (17)

    "Mixed refuse" means garbage and rubbish placed and stored together.

    (18)

    "Owner" means and includes, in addition to the record titleholder, any person residing in, renting, leasing, occupying, operating or transacting business in any premises.

    (19)

    "Person" means an individual, firm, partnership, domestic or foreign corporation, company, association, trust or other legal entity, and includes a trustee, receiver, assignee or similar representative thereof, but does not include a governmental body.

    (20)

    "Private waste collector" means any person other than a town waste collector, who collects or transports building waste, bulk waste, commercial waste, household waste, industrial waste or institutional waste, regardless of the place of origin, within and over the streets of the town.

    (21)

    "Residential premises" means single family dwellings, multiple family dwellings, garden apartments, condominiums and other like housing units.

    (22)

    "Rubbish" means all cardboard, plastic, metal or glass containers, waste paper, rags, sweepings, small pieces of wood, excelsior; rubber, leather, leaves, lawn cuttings, tree trimmings and hedge trimmings not over five inches in diameter nor over four feet in length, tree roots or stumps small enough to be contained in a bushel basket, articles not more than six feet in length nor more than fifty pounds in weight, small rocks and similar waste that ordinarily accumulate around a residence, business or industry, but excludes animal carcasses, ashes, building waste, bulk waste, garbage, hazardous waste and industrial waste.

    (23)

    "Solid waste" means garbage, waste, rubbish and other similar discarded solid or semisolid materials, including but not limited to such materials resulting from industrial, commercial, agricultural and domestic activities, and including motor vehicles.

    (24)

    "Town" means the town of Wilton, Iowa.

    (25)

    "Town waste collector" means any person employed by the town from time to time to collect or transport commercial waste, household waste or institutional waste, within and over the streets of the town.

    (26)

    "Yard waste" means organic debris (e.g. grass clippings, leaves, tree limbs, bark, branches, flowers, and similar organic debris) which is produced as part of yard and garden development and maintenance.
