§ 7.12.070. Disposal.

  • (a)

    Each person producing or responsible for solid waste shall be responsible for the disposal thereof in accordance with the provisions of this chapter and in accordance with such regulations as may be established by the city to implement the provisions hereof.

    (b)

    No person shall burn any solid waste within the city limits.

    (1)

    No receptacle used in such burning shall be allowed on private property.

    (2)

    No burning shall be on any streets, curb and gutters, alleys, sidewalks and other city property and right-of-ways.

    (c)

    Unless herein otherwise provided, all waste shall be deposited at such disposal sites as may be designated by the city to receive waste, and particular kinds of waste may be deposited at disposal sites other than designated sites when such sites and the methods of disposal are approved by the city administrator or by his authorized representative.

    (d)

    The administrator or his authorized representative shall establish regulations as to the time and use of the disposal sites designated by the city to receive waste, and it shall be unlawful for any person to use any such site except in compliance with such regulations.

    (e)

    All city waste collectors and private waste collectors shall, if requested by the administrator or by his authorized representative, submit proof of the origin of the waste offered for disposal and certify that such waste originated within the city.

    (f)

    In the discretion of the administrator or of his authorized representative, certain wastes may be excluded from those solid wastes which may be deposited at any disposal site, including:

    (1)

    Automobile bodies and other bulky objects which may require special processing;

    (2)

    Trees and tree limbs exceeding ten feet in length;

    (3)

    Burning materials or materials containing hot or live coals; and

    (4)

    Wastes which present a special hazard to department and disposal site.

    (g)

    No person shall set fire to or burn any waste upon a designated disposal site without the permission of the administrator or of his authorized representative.

    (h)

    All waste delivered and deposited at a designated disposal site is the property of the city and no person shall separate, collect or carry off any waste unless authorized to do so by the administrator or his authorized representative.
