§ 8.04.170. Duty of police officer to give notice of impoundment.

  • (a)

    If the police officer impounds any dog or cat, such officer shall attempt to find the owner thereof, and if the owner is found, or if the dog or cat is licensed, such officer shall have the authority to issue a notice or summons to the owner or person listed as the licensed owner in the manner provided in subsection (b) of this section and on notice form.

    (b)

    The notice provided for in subsection (a) of this section shall be in the following or a similar form:

    NOTICE

     You are hereby notified that a ____________ male ____________ female dog/cat ____________ believed to be owned by you ____________ of which you are the registered licensed owner, has been impounded by the Police Officer of the City of Wilton because said dog/cat was found to be running at large ____________ with ____________ without a proper license.

     As the owner of said dog/cat, you are liable for a fine up to one hundred dollars ($100.00) for violating Wilton Municipal Code.

     You may redeem the dog/cat upon showing the Police Officer that the dog/cat has been inoculated. And upon payment of a fee of $25.00 for the first day of impoundment and $5.00 a day for each day that the dog/cat has been impounded. Such fee shall be paid at the City Hall office and a receipt shall be given therefore.

     If redemption of the dog/cat is not made within five (5) days of the date of this notice, the dog/cat shall be disposed of in accordance with the provisions of Chapter 8.04 of the Wilton Municipal Code.

     You are hereby notified that if you do not appear within five (5) days of the date of this notice, I will appear before a Magistrate of the District Court and sign a complaint formally charging you with violation of Chapter 8.04 of the Wilton Municipal Code.
