§ 9.10.100. Selling or dispensing beer.

  • Special permission may be granted to any bona fide organization to sell or dispense beer for special functions within any shelter house or shelter or within a forty-foot radius thereof with a permit from the city, which permit shall be issued only pursuant to the following:

    (1)

    The organization shall first file a written application with the park board;

    (2)

    If the park board determines, after a review of all material facts, that the granting of such permission would not be detrimental to the public health, safety, comfort and general welfare, the park board may issue the permit;

    (3)

    If the park board determines that the granting of such permission would be detrimental to the public health, safety, comfort and general welfare, the park board may deny the permit. In the event of a denial of a permit by the park board, the applicant organization may, within twenty days of the date of the denial of the permit, apply to the council for a review of the park board decision. If the council determines, after opportunity for hearing granted to the organization, and after considering the denial of the park board and reviewing all other material facts, that the granting of such permission would not be detrimental to the public health, safety, comfort and general welfare, the council may overrule the park board and issue the permit.

    Nothing contained in this section is intended to supersede any permits which may be required by any other applicable federal, state, or local law or ordinance.
