§ 9.16.130. Intoxication.

Any person who is or appears to be intoxicated or incapacitated by alcohol or other chemical substances in a public place and in need of help shall be taken by a peace officer to an approved facility as set forth in Chapter 125 of the Code of Iowa. If the person refuses the proffered help, the person is in violation of this chapter and may then be charged with intoxication.
